OP Doctors File Suit to Block New Kansas Abortion Law

(AP) – Two Kansas doctors have expanded their legal attack on state regulations for abortion providers. Dr. Herbert Hodes (HOH’-dees) and his daughter, Dr. Traci Nauser (NOW’-zuhr) have filed a lawsuit in the state court system.

Attorney Bonnie Scott Jones said Wednesday that the doctors areĀ  trying to protect rights guaranteed under the state constitution.

The two doctors perform abortions at their offices in Overland Park. They filed a lawsuit in federal court in June, and a judge has put state regulations on hold until that lawsuit is heard.

The doctors filed their state lawsuit in Shawnee County District Court last week. Jones said a judge issued an order blocking enforcement of state regulations until a hearing Dec. 6 and 7.

State officials did not immediately return telephone messages seeking comment.
